Terms of service

These terms govern your access to and use of the Clarve website and the products and services offered through it. By browsing the site, creating an account, or placing an order, you accept these terms in full. If you do not accept them, do not use the site.

Who we are

Clarve is a South African brand offering prescription-grade compounded peptide therapy. All medicines sold through this site are compounded by Clarve's Compounding Pharmacy, a pharmacy registered with the South African Pharmacy Council (SAPC) and operating in terms of the Pharmacy Act 53 of 1974 and the Medicines and Related Substances Act 101 of 1965. Prescriptions are issued by independent practitioners through TruMD, a registered telehealth platform, where appropriate.

Any reference to "we", "us", or "Clarve" means Clarve and its associated dispensing pharmacy. Any reference to "you" or "the customer" means the person accessing the site or placing the order.

Eligibility

You may use the site and place orders only if you are 18 years of age or older, legally capable of entering into a binding contract, and ordering for use within South Africa. By placing an order you confirm that the information you have provided about yourself, your medical history, and your prescriber is accurate and complete.

Prescription requirement

The peptide medicines sold through this site are scheduled medicines. They cannot be supplied without a valid prescription from a South African registered medical practitioner. Where a prescription is required, your order will only proceed once a prescription has been issued and verified by the dispensing pharmacy. Submitting an order does not by itself create a contract for the supply of medicine. The contract is concluded only when the pharmacy confirms that a valid prescription is in place and the order has been accepted for dispensing.

Prescriptions are valid for the period specified by the prescriber and in accordance with South African pharmacy regulations. Once repeats are exhausted, a new prescription is required before any further supply.

Account registration

You may be required to register an account to place orders, manage prescriptions, or access patient-specific information. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@clarve.co.za if you believe your account has been accessed without your authorisation.

Orders, pricing, and availability

All prices are displayed in South African Rand and include VAT where applicable. We reserve the right to correct pricing or product information errors and to cancel orders affected by such errors, with a full refund of any amount already paid. Product availability depends on raw ingredient supply and compounding capacity. Where a product cannot be supplied within a reasonable time, we will notify you and offer a refund or an alternative.

We may decline or cancel any order in our discretion, including where a prescription cannot be verified, where supply would be clinically inappropriate, or where we suspect fraudulent or unlawful activity.

Payment

Payment must be made in full at the time of ordering, using one of the payment methods made available on the site. Compounding does not commence until payment has cleared.

Delivery

Delivery is governed by our Shipping policy, which forms part of these terms. Risk in the medicine passes to you on delivery to the address provided at checkout, or on collection where collection is selected.

Returns and refunds

Compounded medicines are prepared specifically for the named patient and cannot be returned once they have left our pharmacy. Refunds and replacements are governed strictly by our Refund and returns policy, which forms part of these terms. The Consumer Protection Act expressly excludes medicines and pharmaceutical products from cooling-off and return rights.

Medical information and disclaimer

Information on this site is provided for general educational purposes. It is not medical advice and is not a substitute for consultation with a qualified healthcare practitioner. Do not start, stop, or alter any treatment based solely on information from this site.

Peptide therapy is not appropriate for everyone. You must disclose your full medical history, current medications, allergies, and any pregnancy or breastfeeding status to your prescriber. Use the medicine strictly in accordance with the directions on the label and the guidance of your prescriber. Do not exceed the prescribed dose. Store the medicine as directed and do not use it past its Beyond Use Date (BUD).

If you experience an unexpected adverse reaction, stop the medicine and contact your prescriber or seek medical assistance immediately, then notify us at hello@clarve.co.za so that we can investigate and report where required.

Acceptable use

You may not use the site or any product purchased through it for any unlawful purpose. You may not resell, redistribute, or supply Clarve medicines to any other person. You may not attempt to interfere with the security or operation of the site, or to access any account or data that does not belong to you.

Intellectual property

All content on the site, including text, graphics, logos, images, product names, formulations, and software, is the property of Clarve or its licensors and is protected by South African and international intellectual property laws. You may view and use the content for your personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

User submissions

If you send us feedback, suggestions, reviews, or other materials, you grant us a non-exclusive, royalty-free, worldwide right to use and publish those materials in connection with our business, with attribution where reasonable. You confirm that any material you submit is your own and does not infringe the rights of any third party.

Privacy and data protection

Your personal information, including any health and prescription information, is processed in accordance with our Privacy policy and the Protection of Personal Information Act 4 of 2013 (POPIA). By using the site you consent to the processing described in the Privacy policy.

Third-party services

The site uses third-party services, including but not limited to Shopify for hosting and payments, courier providers for delivery, and TruMD for prescriber services. Your use of those services may be subject to their own terms and privacy notices.

Limitation of liability

To the maximum extent permitted by law, Clarve, its pharmacy, directors, employees, and contractors are not liable for any indirect, incidental, special, or consequential loss arising from your use of the site or the products, including loss of income, profit, data, or goodwill. Nothing in these terms limits liability for death or personal injury caused by gross negligence, for fraud, or for any other liability that cannot be limited under South African law.

Our total liability for any direct loss is limited to the amount you paid for the specific order giving rise to the claim.

Indemnity

You indemnify Clarve and its pharmacy against any claim, loss, damage, or expense arising from your breach of these terms, your misuse of any product, or your provision of inaccurate information to us or to your prescriber.

Changes to these terms

We may update these terms from time to time. The current version is always the version posted on this page. Material changes will be communicated by email or by a clear notice on the site before they take effect. Your continued use of the site after changes take effect means you accept the updated terms.

Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these terms, the site, or any order placed through it is subject to the exclusive jurisdiction of the South African courts.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect.
